If you are a victim of investment fraud, you are in principle entitled to compensation. This is not an empty promise — it is based on Dutch law, specifically on tort/unlawful act (Article 6:162 of the Dutch Civil Code) and directors’ and officers’ liability. When someone has induced you to invest money through deception and you have suffered damages as a result, you have a legal right to compensation for those damages.
What can you claim as compensation?
Your compensation consists of multiple components. First of all, your investment loss: the total amount you invested and did not get back. This is the core of the claim. On top of that comes statutory interest on your investment loss, calculated over the entire period that you have lost your money. For investments made ten or twenty years ago, the statutory interest can represent a substantial amount. Finally, additional compensations may be awarded by the judge, such as reimbursement of costs incurred.
Who is the claim directed against?
A frequently heard reaction is: “The company is bankrupt, so my money is gone.” But that is incorrect. The bankruptcy of the company is not the end of the road. The claim is directed at the founders and directors who are personally responsible for the unlawful actions. Via directors’ liability, these individuals can be held accountable with their private assets for the damages they have caused.
This is a fundamentally different route than waiting for a payout from the receiver in a bankruptcy (where usually nothing is left for ordinary creditors). The mass claim targets the individuals who made the money disappear — not the empty company.
