Update Fraud Investigation & Invitation for Joint Claim Procedure

Bureau Fraude Recht & Geldzaken B.V. (BFRG) has, in collaboration with prominent Dutch and American fraud attorneys, completed a large-scale international forensic investigation. This in-depth investigation focused on cash flows, bank accounts, individuals, corporate entities, subsidiaries, and assets in the Netherlands, Brazil, and several other countries.

From this thorough fraud investigation, the following facts have now come to light:

  • Ponzi scheme: A fraudulent scheme has been identified.

  • Misappropriation of investment funds: The invested funds were largely not used for the purposes for which the investors paid.

  • Embezzlement of proceeds: Funds generated from logging operations were embezzled and unlawfully appropriated.

  • Plantation mismanagement: Plantations were not maintained, or poorly maintained. Furthermore, the final harvest took place three years earlier than scheduled, without distributing the proceeds to the investors.

  • Illegal sales: ‘Green Guarantee Plans’ (Groen Garantie Plannen) were sold without the mandatory safeguards and without the required permits from the Netherlands Authority for the Financial Markets (AFM) and the Dutch Central Bank (DNB).

  • Breach of contract: Contractual obligations and agreements were structurally violated.

  • Culpable errors by the civil-law notary: The notarial deeds drafted for the Floresteca bondholders are incorrect. The first right of pledge was not honored or delivered. The civil-law notary severely compromised the interests of the investors (lenders) by failing to inform them, or by misinforming them, when entering into the private loans to Floresteca.

  • Invalid agreements: All agreements sold to investors by Amazon Teak Foundation (ATF), Goodwood Investments (GWI), and Floresteca Nederland have proven to be legally invalid.

Unlawful Bankruptcies

Because all agreements of Floresteca, Goodwood, and ATF have proven to be invalid, their sale to both domestic and foreign investors has been unlawful. This has far-reaching consequences. We consider the bankruptcies of ATF and Goodwood in the Netherlands to be deliberately orchestrated and unlawful. Foundation BFRG will legally challenge these bankruptcies as non-existent.

Once the writs of summons are drafted this summer, the respective bankruptcy trustees, the administrators of Floresteca B.V. Netherlands, and the court will be notified by our attorneys. This also applies to the creditors’ agreement of Floresteca B.V. Netherlands.

Good news for various groups of investors

1. Bondholders Creditors’ Agreement Floresteca B.V. Netherlands

There is good news for the approximately 600 Dutch bondholders who signed the creditors’ agreement at the time—surrendering their first right of pledge, only to watch their investments evaporate. You can register with BFRG to have your full investment (principal sum) including statutory interest recovered by us.

The first rights of pledge surrendered at the time, and any Goodwood and/or ATF agreements handed over, will be legally reversed and reclaimed by us. Any payments you have already received from Goodwood, ATF, and/or Floresteca will be deducted from the principal sum to be claimed. This also applies to investors who invested via Floresteca in Luxembourg and the United Kingdom.

2. Victims of Foundation Tectona (Stichting Tectona)

Many investors felt more or less forced to agree to the very minimal payout on the 20-25-year final harvest by Foundation Tectona, resulting in a loss of 80% or more of their investment in many cases. These investors can also still register with BFRG. You can have your fully invested principal sum including statutory interest recovered retroactively, minus the amount already paid out by Foundation Tectona.

3. Members of the Association of Teak Participants (Vereniging Teak Participanten – VTP)

The board of the VTP previously decided to take its own risky course via a Class Action in Brazil, despite explicit warnings and prior collaboration attempts by BFRG. As we predicted, this lawsuit was lost and referred back to the Netherlands (since the agreements fall under Dutch law). Due to the VTP board’s repeated unfounded remarks about BFRG, we have ceased further attempts to consult with the board.

However, we do have good news for the members of the VTP. We understand that you are not to blame for the board’s choices. You, too, can still register with BFRG to have your full investment, including statutory interest, recovered. We have now built an exceptionally strong legal position against the Floresteca empire, its directors, founders, and affiliated individuals.
